Who owns New South Wales’ CBM gas?

A New South Wales (NSW) local council’s decision this week to bar CBM exploration and extraction at a site owned by unconventional gas developer Dart Energy comes amid growing uncertainty over who owns the gas produced from coal seams in NSW and whether local authorities have the right to ban projects licensed by the state.

The Marrickville Council voted on Monday evening to prohibit mining, gas exploration and extraction on the site, located in the Sydney suburb of St Peters, because of its proximity to residences and the environmental concerns surrounding those activities.

“This sends a strong signal to both the landholder and Dart Energy that Marrickville Council is united in its opposition to coal seam gas [CBM] in the inner west,” Greens Councillor Max Phillips said in a statement on Tuesday.
